The U.S. Occupational Safety and Health Administration has ordered CSX to compensate a worker it fired in violation of the Railroad Safety Act.
The worker was deemed by OSHA to have been a whistleblower who reported safety concerns.
The Class 1 carrier was ordered to pay more than $220,000 including $71,976 in back pay, interest, and damages, as well as $150,000 in punitive damages.
An OSHA news release said the agency found in its investigation that CSX had “demonstrated a pattern of retaliation” in firing the worker in December 2019.
The agency described CSX’s action as unacceptable. The news release said CSX was penalized for similar whistleblower incidents in 2010, 2016, and 2020.
