OSHA Fines CSX for Firing Whistleblowers

A federal agency has fined CSX more than $667,000 and ordered it to reinstate two whistleblowers who it fired.

The U.S. Department of Labor Occupational Safety and Health Administration found that CSX fired the workers in retaliation for reporting safety concerns.

OSHA said the two workers in a CSX yard in Waycross, Georgia, in November 2017, encountered and reported a blue flag that signaled their train could not move safely.

CSX managers pulled them from the job and later terminated their employment.

After an investigation, OSHA ruled that both actions by CSX were illegal.

The Georgia case is the third OSHA whistleblower merit finding in 10 months related to CSX retaliating against workers who reported safety concerns, OSHA officials said.

In a statement  CSX said it disagreed with the findings that it retaliated against the workers involved and is appealing the decision to an administrative law judge.
